FORCLOSURES - NOTICE OF DEFAULTS

When a Borrower is in default and has received a Notice of Default which indicates loan is part of a security bit the names of the parties on the Notice of Default are not the same as those on Deed of Trust as to Trustee and Beneficiary, then the Borrower can insist that proof that Creditor/Lender is holder in due course of Note pursuant to Commercial Code is provided. If materials are not produced, the Borrower has the right to file an action for Slander of Title, Declaratory Relief and Injunctive Relief.
