EMPLOYMENT LAW - WAGE AND HOUR CLAIMS

Many immigrants are not aware of their workplace rights and wrongly believe that complaining about their working conditions will affect their immigration status. Amo & Associates is committed to ensuring that immigrants are not taken advantage of by employers who do not comply with the law. California law requires that employers to provide paid rest periods and unpaid meal breaks for non-exempt workers. Generally, employees are entitled to a ten-minute rest break for every four hours worked. Also, if an employee works at least five hours in a day, they are also entitled to a thirty-minute meal period. Other examples of wage and hour violations include:

  • Not being paid overtime as legally required
  • Being required to work while "off the clock"
  • Not receiving legally required breaks during the day
  • Being penalized for taking legally required breaks during the day

FORECLOSURES - NOTICE OF DEFAULTS

When a Borrower is in default and has received a Notice of Default which indicates loan is part of a security bit the names of the parties on the Notice of Default are not the same as those on Deed of Trust as to Trustee and Beneficiary, then the Borrower can insist that proof that Creditor/Lender is holder in due course of Note pursuant to Commercial Code is provided. If materials are not produced, the Borrower has the right to file an action for Slander of Title, Declaratory Relief and Injunctive Relief.

COLLECTIONS

Sometimes businesses like credit card or cell phone companies make mistakes that wind up on a credit report. Debtors have the right to ask them to provide proof of their debt. Also, even someone owes money, the law requires that debt collectors treat debtors fairly and prohibits certain methods of debt collection. If debt collectors violate the law with regard to their debt collection practices, a debtor has the right to sue them for the damages suffered as a result. Some examples of such violations include:

  • Harrassment
      -The use of threats of violence or harm, obscene language, etc.
  • False Statements
      -Misrepresenting the amount of the debt owed
      -Falsely implying that the debtor has committed a crime
      -Stating that they will take legal action against the debtor unless the collection agency or creditor intends to do so, and it is legal to do so
  • Unfair Practices
      -Threatening to take the debtor's property unless this can be done legally
      -Collecting any amount greater than the debt, unless state law permits such a charge
      -Depositing a post-dated check prematurely
      -Using deception to make the debtor accept collect calls or pay for telegrams
